ISLAMABAD (Online): The most important meeting of the Supreme Judicial Council (SCJ), the organization that works on accountability of Supreme Court judges across the country, will be held (Monday).

Applications against Justice Sardar Tariq and Justice Mazahir Ali Akbar will be examined. The meeting will examine complaints against Justice Mazahir Naqvi and Justice Sardar Tariq. Appealing to the judicial panel that heard the charges against him, Justice Mazahar Naqvi filed an 18-page preliminary response to the show cause notice, stating that it was not a response to the notice received on October 28, 2023, and that it was not a response. Answer on merit.

In response, Justice Mazahir Naqvi said that the Supreme Court had declared the right to transparent trial judge in the case of Justice Qazi Faiz Isa. Publishing the press release of the Judicial Council hearings without my opinion affects my fundamental rights and that in the case of a unanimous decision the Council can take action against any judge and the SCJ has no authority to take action against a judge by majority decision.

Justice Mazahir Naqvi said Chief Justice Qazi Faiz Isa and Justice Sardar Tariq Masood had delivered an opinion declaring the council rules unconstitutional.
The Supreme Court judge said, “Since the evidence against me was not examined at the council meeting, a show-cause notice was sent to me without verifying the allegations that are against fundamental rights.”

Explaining the objections, he said that on the occasion of my appointment to the Supreme Court, Justice Qazi Faiz Isa opposed my appointment to the Judicial Commission due to Pervez Musharraf’s decision and Justice Sardar Tariq Masood deliberately delayed giving his opinion on the complaints against me.

He said that on April 3, 2023, Chief Justice Qazi Faiz Isa and Justice Sardar Tariq wrote a letter to the former Chief Justice and talked about starting an investigation against me.
In his first response to the Judicial Council, he said that two respected judges should not hear the complaint against me. He said that Justice Qazi Faiz Isa excluded himself from the bench when he objected to them during the reference hearing against Justice Sardar Tariq Masood and Justice Ijaz ul Ahsen.

Judge Mazahir Akbar Naqvi said that the voice alleged in the complaints was also conveyed to me, but the alleged voice was never verified and a commission was formed regarding the alleged voices, and Chief Justice Qazi Faiz Isa and Justice Naeem Akhtar Afghan were also included in the commission. .
He said that all the allegations made against me were unfounded and fabricated, that I was paralyzed because I could not access the complaint and other materials, and that the complete records should be given to me.

Judge Mazahir Naqvi said that the complaints about me sent to the Judicial Council were based on political motives, that the complaints against me lacked transparency and were against the law, and that the members of the Judicial Council were biased against me. The Supreme Court is also biased and cannot be answered.
The Judicial Council issued its press release dated October 27 without my approval.

Judge Mazahir Naqvi said that the purpose of the press release was to publicly mock me through media trial. The action against me is discriminatory and a violation of Article 25. He said that all decisions of the current Judicial Council will be in this direction. It is considered illegal due to prejudice.

Justice Mazahir Naqvi took the stand that the complaint against Justice Sardar Tariq was served without any apparent cause notice to the complainant Amna Malik.
At the meeting on October 27, complaints against Council member Judge Serdar Tarık Masood were also evaluated.

It is worth noting that on October 27, the 5-member Supreme Judicial Council, headed by Chief Justice Qazi Faiz Isa, issued a show-cause notice to Supreme Court Justice Mazahir Ali Akbar Naqvi on a majority basis on the complaint of misconduct and requested the same. Response within 14 days.

In the statement made after the meeting, it was stated that 10 complaints were made against Judge Mazahar Ali Akbar Naqvi, and the council decided, with a majority vote of 3 to 2, to issue a reasoned statement and request him to respond within 14 days. .

In the statement made by the Supreme Judicial Council, it was stated that the judges who opposed the decision said that they needed more time to review the complaints against Judge Mazahar Ali Akbar Naqvi.

In the statement, it was stated that regarding the complaint against Judge Sardar Tariq Masood, a complaint was also made against Judge Sardar Tariq Masood on behalf of citizen Amna Malik.
Justice Mansoor Ali Shah was also included in the council which made the complaint public and apologized to Justice Sardar Tariq Masood for this complaint.
