Petitions were filed on behalf of 30 in service doctors of the state. It was said that the State Government did not give the benefit of 30 percent reservation to the Medical Officers, Demonstrators and Tutors working in the district areas. He was dropped from the priority list. The basis for expelling them was made recently by the state government in the amendment made in the Medical Admission Rules 2018.
Advocates Aditya Sanghi and Siddharth Radhelal Gupta told the court that on July 26, 2022, the admission rules were amended. Till that day the petitioners were eligible for 30 per cent reservation. He had passed the NEET exam. It was argued that the admission process for this session 2022-23 had already started with the NEET exam.
After the results came out, the state government unfairly modified the rules in the middle and made more than 50 doctors ineligible for reservation. It was also argued that the principles laid down by the Supreme Court are clear that once the admission process has started, the rules applicable to it cannot be amended midway.
