A day after the Haryana and Punjab High Court struck down the 2020 Haryana government law providing locals with 75 per cent reservation in private sector jobs, senior Congress leader Manish Tewari on Saturday said it was in the “spirit of the Constitution” and the division was in the “spirit of the Constitution”. The Court defended the essence of Constitutionalism that equality is the rule and reservations are the exception.

The Congress leader said: “The division bench of Justices Sandhawalia and Jeewan upheld the essence of Constitutionalism that equality is the rule and reservations are the exception.”

“In fact, all reservations exceeding the Golden Mean of 50 per cent laid down by 9 Justices in Re Indra Sawhney case violate the Constitution. Great nations cannot be built by giving the principles of Equality and cannot deserve full approval.” aforementioned.
