The bail plea of Aryan Khan, son of film actor Shah Rukh Khan in the Cordelia Cruz drugs case, will be heard in the sessions court at 12 noon on Thursday. Additional Solicitor General (ASG) Anil Singh, appearing for the Narcotics Control Bureau (NCB) on Wednesday, said that Aryan Khan is related to a drug peddler living abroad, so the NCB is in touch with the Ministry of External Affairs and the matter Trying to find out who this drug peddler is.
The ASG has also submitted the information of Aryan Khan’s WhatsApp chat in the court as evidence, in which Aryan Khan was talking about dealing with a large amount of drugs with a foreign drug peddler.
Aryan is in judicial custody for 14 days and is lodged in Arthur Road Jail in the Cordelia Cruz drugs case.
opposed to bail
On Wednesday, ASG Anil Singh, while filing a reply on behalf of NCB in the Special NDPS Court, opposed Aryan Khan’s bail plea. Anil Singh said that even though drugs have not been recovered from Aryan, Aryan has been a part of this entire conspiracy of drugs.
This is the reason that if Aryan comes out of jail then he can tamper with the evidence and escape from the country so he should not be granted bail.
Anil Singh submitted before the court that it was only after Aryan’s interrogation that the NCB arrested drug peddler Achit Kumar and also recovered ganja from him. Achit Kumar has confessed during interrogation that he used to supply drugs to Aryan also.
Anil Singh told the court, Aryan used to take charas from Arbaaz Merchant, another accused arrested in the same case. NCB had earlier also informed in the magistrate court that Aryan was about to take charas from his friend Arbaaz Merchant on the cruise but before that NCB caught him.
Anil Singh also told the court that Aryan and Arbaaz Merchant are very good friends and both take drugs together.
whatsapp chat quotes
ASG Anil Singh made a sensational disclosure in the Special NDPS Court that the NCB is on the lookout for a foreign drugs paddler. For this he is also in touch with the Ministry of External Affairs.
He told the court that Aryan Khan’s WhatsApp chat has revealed that he was in talks with a drug peddler living abroad for large quantities of drugs. However, Singh also said that it cannot be for his own use but it was meant to be used in another way.
Singh was referring to the supply of drugs. Singh said it appears to be part of an international drug network that is still under investigation.
Question on NCB’s work
On the other hand, Aryan’s lawyer Amit Desai raised questions on the working of NCB saying that the investigating agency had spoken about international trafficking in the court on April 4 and today is the 13th, in the meantime NCB has not done any investigation. .
Desai said that Prateek Gaba had invited Aryan to the party but the NCB did not arrest him. Desai said that all the accused are youths, large quantity of drugs have not been found from them and they are in custody for many days, so no further excess should be done on them.
More news from Maharashtra
ASG Anil Singh told the court that action has been taken against Aryan Khan under Section 29 of the NDPS Act. Under this, the person who is accused of an offense is also held guilty as a conspirator for the same crime.
Anil Singh said, “I am pointing this out because in case of conspiracy it is not necessary that drugs should be recovered from all the accused.”
ASG Anil Singh, arguing in the court, said that Aryan Khan used to buy drugs from his friend Arbaaz Merchant and others. In the raid, 6 grams of charas was recovered from Arbaaz Merchant.
Aryan and Arbaaz are both friends, so action has been taken against Aryan also under section 29 of NDPS Act. The drugs found during the raids have revealed that Aryan Khan’s role in the illegal purchase of drugs comes to the fore.
Anil Singh, Advocate for NCB
He said that in the preliminary investigation, it has been found that Aryan Khan used to get Contraband from Arbaaz Merchant. Aryan and Arbaaz have known each other for a long time so this evidence is enough to deny them bail.
debate on section 29
On the other hand, Aryan’s lawyer Amit Desai said that the NCB has imposed section 29 on Aryan, in which it has been said that if drugs are recovered from the accused, then only the accused is arrested under this section.
Neither drugs have been found from Aryan nor money has been recovered from him so that it can be proved that Aryan was about to buy drugs on cruise, so NCB cannot use section 29 in this case.
Amit Desai, Aryan’s lawyer
Advocate Satish Maneshinde had appeared for Aryan’s bail in the Qila Court, but Shah Rukh has hired Mumbai’s renowned lawyer Amit Desai for hearing in the sessions court. He is advocating this case along with Satish Maneshinde.
